We collect personal information from you, including information from your Computer and internet connection such as:
Your name;
Contact information;
Interactions with us including anything you tell us verbally or in writing;
Computer network/ISP;
Identification Documents for Anti-money Laundering and Counter Financing of Terrorism Compliance.
We collect your personal information in order to:
Provide you with legal advice relevant to your circumstances, apply to the NZ Family Court, Ministry of Social Development and Companies Office to complete applications and paperwork on your behalf and meet our obligations under NZ legislation.
Besides our staff, we share some limited information with:
The Family Court and other legal parties to your application as applicable in order to apply for orders under the Protection of Personal and Property Rights Act 1988.
Law Enforcement and NZ Government Agencies such as the Department of Internal Affairs in order to meet our obligations under the Anti-Money Laundering and Countering Financing of Terrorism Act 2009.
Whilst most information shared with your Lawyer is privileged (which means your Lawyer can’t share it with anyone else for any reason), there are certain situations where by law, we would be obliged to share limited information, with an appropriate person (such as law enforcement or medical personnel). (Rule 8.2 of the Lawyers and Conveyancers Act (Lawyers: Conduct and Client Care) Rules 2008):
If we know information about a crime you are going to commit that is punishment by time in jail of 3 years or more;
If we have reason to believe that you are going to hurt yourself or someone else;
Or if it is required by law, our duty to the Court or by order of the Court.
Providing some information is optional. However, if you choose not to provide us with personal information that is necessary to complete your applications, we will be unable to provide the related legal services.
We care about the security of your information and do all we can to keep your information as secure as possible. We keep your information safe by storing all information received in secure cloud based software such as Microsoft 365 and using multi-factor authentication with our IT managed and maintained by experts.
You have the right to ask for a copy of any personal information we hold about you, and to ask for it to be corrected if you think it is wrong.
